Statutory Schedule for Non – Partisan Municipal Elections 2009 Deadlines and Citations – General Information

1. Municipal Election to be held May 12, 2009, N.J.S.A. 40:75-2
Polls are open from 6:00 am until 8:00 pm; The polling places are:

District 1 - Methodist Church, 29 Warwick Road, Rear Entrance
District 2 - Borough Hall, 242 Kings Highway East, Room 102
District 3 - Crows Woods Building
District 4 - Middle School, Chestnut Street, Auditorium
District 5 - Middle School, Chestnut Street, Auditorium
District 6 - Elizabeth Haddon School, Redman Avenue
District 7 - Elizabeth Haddon School, Redman Avenue
District 8 - Lutheran Church, Wayne Ave. & Wood Lane
District 9 - Lutheran Church, Wayne Ave. & Wood Lane
District 10 - Tatem School, Glover Avenue, Music Room

Results will be delivered to and announced (typically beginning around 8:30 pm) in the Borough Hall Auditorium after the regularly scheduled Commissioner Meeting

2. Each candidate must reside in the municipality, and must be a registered voter therein for one year prior to the election, N.J.S.A. 40A:9-1.13

3. Each candidate must be at least 18 years of age.

4. Petitions must have at least 1% of registered voters as of the last general election (9,304 x 1% = 94). Each registered voter is permitted to sign the petition of no more than three candidates, N.J.S.A. 40:45-8 (Petitions Attached)

5. Petitions must be accompanied by affidavit of candidate and affidavit of campaign manager, N.J.S.A. 40:45-8 (Affidavits Attached)

6. March 19, 2009 - Nominating petitions are due to the Municipal Clerk 54 days prior to the election by 4:00 pm, N.J.S.A. 40:45-8

7. When a petition of nomination is presented for filing to the Municipal Clerk, he/she shall examine it and ascertain whether or not it conforms to the provisions of the law. If it does not conform, the Municipal Clerk shall retain the petition and notify the person nominated of the defect by written notice delivered to them personally or by certified mail, N.J.S.A. 40:45-9

8. Where the nominating petition, or any affidavit or affidavits thereto is found defective, the candidate named therein may file such amendment or amendments as may be necessary to eliminate the defect, whether of matters of substance or form, and when so amended the effect shall be as if the petition had been originally filed in the amended form. After the last day for the filing of the original petition, no amendment may be made for the purpose of adding the name of any person who did not sign the original petition, nor shall any amendment be made at any time for the purpose of changing the name of the candidate or the office for which he was to be nominated. No amendment to a nominating petition shall be made and filed less than 48 days before the election. (N.J.S.A. 40:49-9)

9. March 25, 2009 - Last day to amend a nominating petition, which correlates to 48 days before the election pursuant to N.J.S.A. 40:45-9. However, no signatures may be added on or after March 19, 2008 at 4:00 pm.

10. The Municipal Clerk shall immediately provide the Election Law Enforcement Commission with the official certification of the filing or withdrawal of a petition of nomination, N.J.S.A. 40:45-8

11. March 26, 2009 - Drawing for position on the ballot in the Clerk’s Office (Room 101) of Borough Hall at 3:00 pm on the 47th day before the election, N.J.S.A. 40:45-12

12. April 21, 2009 - Last day to register to vote in regular Municipal Election

13. May 5, 2009 - Last day to request absentee ballot from County Clerk by mail, 7 days prior to election

14. May 11, 2009 - Last day (by 3:00 pm) to make application for an absentee ballot in person or by designated messenger at the County Clerk’s Office.

15. May 19, 2009 - Term of Office for each elected commission begins (at 12:00 noon), N.J.S.A. 40:75-2
